Program Overview:
This Quick Teleconference will explore new developments and trends in the federal prosecution of environmental crimes. The program features the nation’s top environmental prosecutor, Ms. Stacey Mitchell. Ms. Mitchell has served as Chief of the U.S. Department of Justice’s Environmental Crimes Section since 2007, addressing a variety of important environmental crimes cases, including appellate challenges to the jurisdictional reach of the Clean Water Act and Clean Air Act.

Ms. Mitchell will provide practical advice about what makes a case subject to criminal enforcement and how and when to approach government attorneys about an ongoing EPA criminal investigation. She will also discuss her Section’s priority areas and provide insights on recent developments. These include:

• Challenges to sentences under the Crime Victim’s Rights Act
• Case selection and deferred prosecution agreements
• EPA’s proposed pilot program for new owners who self-report violations
• Waiver of attorney client privilege
• Clean Water Act and Clean Air Act jurisdictional challenges

Educational Objectives:

* Provide guidance on recognizing the types of environmental violations that may end up being viewed as potentially criminal and how to approach the government when a client becomes a suspect in an environmental crime investigation
